MINUTES OF THE LARIMER COUNTY BOARD OF ADJUSTMENT
(May 26, 2009)
The regular meeting of the Larimer County Board of Adjustment was held in the County Board Hearing Room in the Larimer County Courthouse, Fort Collins, Colorado at 7:00 p.m., May 26, 2009 at which time the following business was transacted.
Board Members Present: Jean Christman, Eric Berglund, Evelyn King, Greg Christensen, and Matt Strauch
Board Members Absent: Alan Cram and Peter Bohling
Staff Present: Samantha Mott, Planning
William Ressue, Assistant County Attorney
Minutes: Greg Christensen moved and Evelyn King seconded the Motion to approve the April 18, 2009 Minutes of the Larimer County Board of Adjustment as presented. Board members Jean Christman, Eric Berglund, Evelyn King, Greg Christensen, and Matt Strauch voted in favor of the Motion. The Minutes were unanimously approved.

Request: The Application of Terry and Anne Marie Whitaker, requesting five variances was presented to the Board. The Application requested setback variances (i) to allow the existing residence, which will be converted into an accessory building, to remain 18 feet from the north side property line and 66 ½ feet from the centerline of North Taft Hill Road (historically where the front porch existed) and be expanded to be 19 feet from the south side property line; (ii) to allow a new home to be 10 feet from the north side property line and 15 feet from the south side property line; (iii) to allow an existing 28 square foot building located over a wellhead to remain 13.7 feet from the north side property line and 60.8 feet from the centerline of North Taft Hill Road; (iv) to allow three portable buildings to be 10 feet from the north property line; and (v) to allow a greenhouse to be 18 feet from the north property line in the RE-Rural Estate zone.
Action: Jean Christman moved and Greg Christensen seconded the Motion to approve the Application with conditions. Board members Jean Christman, Eric Berglund, Evelyn King, Greg Christensen, and Matt Strauch voted in favor of the Motion. The Application was approved with conditions.

Request: The application requested a setback variance to allow a garage/workshop to be 30 feet from the edge of the right-of-way for East Mulberry and an addition to an existing outbuilding to be 70 feet from the edge of the right- of-way for East Mulberry rather than the required minimum of 80 feet from the edge of right-of-way in the R-Residential zone.
Action: Jean Christman moved and Greg Christensen seconded the Motion to approve the Application with conditions. Board members Jean Christman, Eric Berglund, Evelyn King, Greg Christensen, and Matt Strauch voted in favor of the Motion. The Application was approved with conditions.

Request: The application requested a setback variance to allow a detached garage with a deck and an outhouse to be 45 feet from the centerline of County Road 52E and 30 from the centerline of a stream rather than the required minimum of 70 feet from the right-of-way centerline and 100 feet from the centerline of the waterway.
A request to table the Levick Setback Variance was made. Neighbors appeared and were in opposition of tabling the matter.
Evelyn King moved and Matt Strauch seconded the motion that the Board table this matter to August 25, 2009 at 7:00 p.m.
The question was called and members Jean Christman, Eric Berglund, Evelyn King, and Matt Strauch voted in favor of the motion. Member Greg Christensen voted against the motion tabling the matter. The motion received the four votes needed to pass, therefore, the matter was tabled to August 25, 2009.

Request: The application requested a setback variance to allow a detached garage to be located 4 feet from the edge of the road easement and the existing home to remain 20 feet from the edge of the road easement rather than the required minimum of 45 feet in the E-Estate zone.
Action: Matt Strauch moved and Evelyn King seconded the Motion to approve the Application with conditions. Board members Jean Christman, Eric Berglund, Evelyn King, Greg Christensen, and Matt Strauch voted in favor of the Motion. The Application was approved with conditions.
Written Decision: For each application, the Board’s findings and decision will be reduced to writing in the form of a Resolution. The written Resolution is the final decision by the Board and will be recorded in the records of the Larimer County Clerk and Recorder.
Adjournment: The meeting was adjourned at 8:25 p.m.
