C.        POSTING OF MINUTES IN COMPLIANCE WITH THE OPEN MEETINGS LAW

 

Suggested Motion:  I move that the Board of Adjustment designate the Oak Street entrance to the Larimer County Courthouse as the public posting place for notices of all official actions and public meetings in accordance with the requirements of the Colorado Open Meetings laws (CRS 24-6-402)

Request:  A setback variance request to allow a proposed house to be setback 10‘ from the side property line instead of the required 25’ and also to allow the house to be setback from an intermittent stream 50’ instead of the required 100’ as indicated in Sections 4.9.2.A and 4.1.3.B.2.

                                          Location:  NE 22-6-72; located off Dunraven Glade Rd., Miller Fork Rd., and Barking Coyote Ct. in Glen Haven.

Applicant/Owner:  John & Linda Stocker,   6725 34th St. Greeley, CO 80634

 

Development Services Team Recommendation:  The Larimer County Development Services Team recommends approval of this request , Stocker Setback Variance, File #10-BOA0782, subject to the following conditions:

 

1.   Failure to comply with any conditions of the variance approval may result in reconsideration of the use and possible revocation of the approval by the Board of Adjustment.

 

2.   This approval shall automatically expire in one year unless the applicant takes affirmative action consistent with this approval.

 

3.   This variance is only for the building(s) as submitted with this variance application.  All future buildings, additions, and improvements must meet County setback requirements.

 

4.   After the applicant applies for a building permit, the Larimer County Building Department must be provided with a written certification by a Colorado Licensed Land Surveyor that the proposed structure is located where shown on the Larimer County approved plot plan for this development.

            Detailed Information

                        Request:  A setback variance request to allow a side setback for an existing deck to be 5 feet from the southwest lot line instead of the required 25 feet for the E-1 Estate zoning district, listed in Section 4.1.7.B.2.

                        Location:  SW 12-10-74; located off County Road 73C, north of Tami Road, off Huron Road.

                        Applicant/Owner:  Edward & Charlotte Miller, 305 Huron Rd., Red Feather Lakes, CO 80545

 

Development Services Team Recommendation:  The Larimer County Development Services Team recommends approval of this request , Miller Setback Variance, File #10-BOA0783, subject to the following conditions:

 

1.   Failure to comply with any conditions of the variance approval may result in reconsideration of the use and possible revocation of the approval by the Board of Adjustment.

 

2.   This approval shall automatically expire in one year unless the applicant takes affirmative action consistent with this approval.

 

3.   This variance is only for the building(s) as submitted with this variance application.  All future buildings, additions, and improvements must meet County setback requirements.
