The Larimer County Public Trustee is appointed by the Governor of the State of Colorado, for a term concurrent with the Governor's term. The Public Trustee is appointed to perform public service duties as prescribed in Title 38 of the Colorado Revised Statutes. These duties include processing documents pertaining to Foreclosures of Deeds of Trust and Release of Deeds of Trust.
Foreclosure sales are held in the Public Trustee office every Wednesday (except holidays) at 10 a.m.
Final Pre Sale List will be posted after 3:30 p.m. on Tuesday. A preliminary list may be available prior to that time. Please be advised that these lists are provided to you as a convenience and there is no guaranty as to the accuracy. (Lists are available online.)
Notice to an owner in foreclosure: If your property goes to foreclosure auction sale and is purchased for more than the total owed to the lender and to all other lien holders, please contact the Public Trustee's office after the sale because you may have funds due to you. Owners of record do not need to pay any fee to the Public Trustee or any third party in order to collect excess funds.
If the borrower believes that a lender or servicer has violated the requirements for a single point of contact in section 38-38-103.1 or the prohibition on dual tracking in section 38-38-103.2, the borrower may file a complaint with the Colorado Attorney General, the Federal Consumer Financial Protection Bureau (CFPB), or both. The filing of a complaint will not stop the foreclosure process.
